The signing ceremony: what actually happens

Under section 9 of the Wills Act 1837, your Will is only valid if you follow these steps:

  1. Gather two adult witnesses. They must be over 18, of sound mind, and not beneficiaries (or married to beneficiaries).
  2. All three people in the same room. You sign the Will while both witnesses watch.
  3. Each witness signs. Both witnesses sign in your presence. Their full name and address goes on the Attestation page.
  4. Date it. Use today's date. No pre-dating, no future-dating.
  5. Store it safely. A fireproof box at home, or your solicitor, or the government's free Will storage service.
